Home-based Food Business Registration

You must register your home-based food business and comply with food safety standards if you are preparing or storing food at home for sale to consumers. 

Preparing or storing food at home for later sale (including in-kind rewards) is considered a food business and requires registration with us. 

You must follow the same rules that apply to commercial food premises if cooking food for sale at home.

The State Environmental Planning Policy (Exempt and Complying Development Codes) 2008 subdivision 22 does not allow for any exemptions for home businesses, home industries and home occupations involving the manufacturer of food products. This means all home food businesses must first obtain development consent for any residential premises to be used for the manufacture of food products for sale.

Council would only approve development applications for home-based food businesses that prepare and manufacture food products that are not potentially hazardous and low risk. Low risk food products are food products that do not require temperature control to ensure they are safe to eat ie- food products that are not required to be stored refrigerated at or below 5 degrees celsius or at or above 60 degrees Celsius, to maintain the microbiological safety of the food.

Examples of a home-based business include: 

  • Baking sweets, cakes, or bread at home in a domestic kitchen for sale at markets etc
  • Preparation of food for sale to online customers.
