How to Access Council Information

As a member of the public, you have the right to access certain government information.

Principles of Public Information Access

Council is committed to the following principles regarding public access to documents and information:

  • Open and transparent government;

  • Consideration of the overriding public interest in relation to access requests;

  • Proactive disclosure and dissemination of information;

  • Respect for the rights and privacy of individuals; and

  • Respect for the commercial value of information and copyright provisions.

Open Access Information

Council will make information that is classified as ‘open access information’ publicly available unless there is an overriding public interest against the disclosure of the information.

Under section 18 of the GIPA Act certain information is prescribed that must be made available free of charge on Council’s website or made available for inspection, this includes:

  • Policy documents

  • Disclosure Log of formal access applications that might be of interest to other members of the public

  • Agency Information Guide

  • Government Contracts Register

  • An agency’s record (if any) of the open access information that it does not publish due to an overriding public interest against disclosure or would impose unreasonable additional costs on Council

Register of Interests

The Disclosures of Pecuniary Interest Returns, required to be lodged by Councillors and Designated Officers in accordance with the Code of Conduct, are available for inspection free of charge at the Rockdale Administration Centre by contacting the Right to Information Officer.

Council has made a determination under section 6 of the GIPA Act, that the Disclosure Returns should not be available on this website as there is an overriding public interest against disclosure on the website.

The determination has considered the requirement to publish the Disclosure Returns (open access documents) on our website by deleting private information. Bayside has concluded that much of the information in the Disclosure Returns, would need to be redacted to make it suitable for publishing. Such removal of the information would make it misleading relative to the intent of the requirement and therefore not practical.  More detail is included in the determination itself.

Councillors and Designated Officers complete their returns on this blank disclosure return. The completed disclosure returns are not published on our website.

Proactive Release of Information

Council proactively releases information with a commitment to providing as much information to our community, for free or at the lowest cost possible.

Informal Access to Information

A member of the public may request access to information that is not available on Council’s website. Council may release information held in response to an informal request (that is, a request that is not an access application) unless there is an overriding public interest against disclosure of the information. An application fee does not apply to an informal information request but fees may apply for photocopying. Council is not required to consider an informal request and applicants may be required to submit a Formal Access Application.

Formal Access Application

The release of information that is not made available by either mandatory (open access), proactive or informal release may be made available by way of a Formal Access Application. Examples of formal applications may involve;

  • large volumes of information that involves extensive searching and requires a large diversion of resources

  • information which could not be provided informally

  • Information that contains material that is sensitive in nature and requires careful balancing of public interest considerations

  • information that is subject to legal professional privilege

  • Information that relates to a third party who must be consulted

A standard application fee of $30 applies. Council may impose a processing charge of $30 per hour plus photocopying charges for dealing with your application. Applications will generally be dealt with within 20 working days. Applications requiring third party consultations may take an additional 14 days to finalise.


Disclosure Log 2018-2020

Section 25 of the Government Information (Public Access) Act 2009 (NSW) (GIPA Act) requires agencies to keep a disclosure log as part of their mandatory open access information.

A disclosure log publishes details of information released in response to access applications that the agency considers may be of interest to other members of the public. Details are entered into the disclosure log after the access application has been decided.
