Footway trading dining and displays


You need to apply for approval to use the footway (footpath) for outdoor dining or the display of goods.

Sharing the footpath

We are committed to ensuring everyone in our community can enjoy the many social, cultural, and business benefits of living and working in the area.

Footpath trading opportunities are available for traders that are in the agreed Footway Trading Zones which are designated to allow best trading in the safest way. 

Our Footway Trading Guidelines explains how Footway Trading Zones are applied. 

Our  Footway Trading Policy requires that footpaths be unobstructed, and pedestrians have safe access.

Footway Trading Zone

Individual Footway Trading Zones are identified by brass markers on the footpath. 

  • A minimum of two brass markers will be used to identify each zone.  
  • The approved trader must ensure the markers remain present, visible and undamaged, and they must always operate in the markers.  
  • Approved traders must advise us if there are any missing or damaged markers 

There are eight commercial and retail foot path trading zones, each has a fee according to its location.

H Mascot Town Centre, Mascot Station, Botany, Banksmeadow, Rosebery, Pagewood and Daceyville 
Other Unique value locations (assessment on an individual basis with licensee to pay for initial valuation) 

 

Display of goods

The design and construction of furniture is to be of a satisfactory standard and approved by us. See below for approved design parameters. 

  • Display furniture can’t be higher than 1.5 metres, and a minimum height of 0.75 metres  
  • Display furniture must: 
    • not obstruct pedestrians and only placed in the Footway Trading Zone 
    • be placed during the business hours and removed at close of business 
    • be secured but not fixed to any public structure e.g footpath, building, or pole(s). 
    • be of contrasting colour to their background to assist the visually impaired. 
  • Saleable goods: 
    • must be placed on display furniture wherever possible 
    • are not to be displayed on milk crates, pallets, cardboard, or foam boxes 
    • must only be put in the Footway Trading Zone. 

 

If you change or alter the placement of your Footway Trading licence, you will need to lodge a variation and receive approval before you make any changes. 

Supporting documents

You will need the following documents ready before applying: 

  • Site plan (A4 size 1:100) of existing setout  
  • Site plan (A4 size 1:100) of proposed Footway Trading Zone 
  • Site plans need to show: 
    • dimensions, e.g width of the building frontage and footway from the kerb to the building line  
    • location of building line  
    • neighbouring properties  
    • existing infrastructure 
    • location of proposed furniture and/or display items 
    • and service points to premises. 
  • Details of other relevant approvals - e.g DA/consent 
  • ABN/ACN – Supply proof. Visit Business.gov.au for more information. 
  • Photographs of the site - showing the proposed Footway Trading Zone relative to buildings and existing features of the footpath area 
  • Details of furniture, including photographs, colour, markings, designs, drawings etc. 
  • Coloured photograph or detailed design drawing of proposed advertising logo. Show size and location within the Footway Trading Zone 
  • Provide a ‘Certificate of Currency’ where you have included Bayside Council as an interested party for the period of the Footway Trading approval. Provide $20M if your proposal is on a Transport for NSW controlled road or $10M if on any other road or place.  
  • Letters of Consent, are to be submitted yearly from: 
    • your landlord 
    • a neighbouring landlord, if asking to operate in front of an adjacent property. 
  • Liquor licence – supply a copy (if applicable). 

Apply online

Press the Apply online button to start the registration process, you will be asked to make a payment to complete lodgement. 

Payments can be made by MasterCard or Visa which incur a service fee of 0.5% 

Apply in person

Download and print the application form and lodge your completed form at any of Bayside Council’s Customer Service Centres.

Payment is preferred by cheque, money order, debit or credit cards (Visa and Mastercard).  

Payments made using a credit card will incur a service fee of 0.5%

Fees and charges

Payments made by MasterCard or Visa incur a service fee of 0.5% 

There is an application fee, plus a charge per square metre which is zone dependent
